Luctaris Terms and Conditions

1. About these Terms

1.1 These Terms and Conditions (the "Terms") are an agreement between you and Matthew DeMaio, who runs this pilot under the working name Luctaris Intelligence (the "Organizer", "we", "us"). They include your consent to being recorded and to the uses of your data described here.

1.2 They are the one agreement for the pilot. They apply to the athlete side of the app (the Athlete Portal, with MatLog and RollLens) and to Coach Console. Section 12 adds duties for coaches. These Terms replace the earlier pilot consent, pilot terms of use and coach confidentiality agreement.

1.3 You accept these Terms by ticking one box in the app: "I am at least 18 and a legal adult where I live, and I agree to the Luctaris Terms and Conditions (version 0.2)." By ticking it, you electronically consent to the recording and to every use described in these Terms, including Google Cloud Gemini analysis, automatic AI match notes and coach corrections of them, body tracking on the viewer's device, body-position summaries when that feature is on (7.4), and AI model training. Your tick has the same effect as a signature. The Organizer publishes these Terms in the app and does not sign them separately.

1.4 The app records which account accepted (with its email address), the date and time, the version and a fingerprint (hash) of the exact text you accepted. You can view and save a copy in the app at any time.

2. Who runs the pilot

2.1 Matthew DeMaio, using the working name Luctaris Intelligence, runs the pilot and controls your data. Contact: [EMAIL]; address: [ADDRESS]. Filming: [VENUE], [START DATE] to [PILOT END DATE]. Compensation for taking part, including for coach reviews: [NONE OR TERMS]. A later company needs new permission to receive identifiable pilot data.

3. Who can join

3.1 You can use the pilot only if the Organizer invited you and you are at least 18 and a legal adult where you live. Keep your sign-in to yourself. Knowing the web address doesn't give anyone access.

3.2 Joining is optional and does not affect your training. Every adult filmed must agree to these Terms before filming.

4. What is collected and how it is used

4.1 RollLens uses round video with sound, short clips, approximate body points (including eyes, ears, nose, mouth corners and hand knuckles), position labels, AI match notes, coach notes and corrections. There is no face recognition or identification across videos. Videos keep the sound the phone records; it is not removed. Coaches you're connected to can hear it. Footage of nonconsenting people or minors is deleted. When the feature in 7.4 is on, RollLens also uses saved body-position summaries, which leave out the face and hand points.

4.2 MatLog uses what you enter. Voice recaps you record are sent to Google Cloud Gemini to be turned into text; the app does not store the voice file. We make no voiceprint. MatLog AI drafts are suggestions: you confirm or correct each item in your drafts.

4.3 Your entries, clips, notes and corrections may train private experimental Luctaris models solely for this pilot, unless you turn model training off (section 10).

4.4 Combined totals, such as coach agreement (4.6), may be shown to funders or advisors only without identifying anyone, and are never described as accuracy.

4.5 Each coach change to an AI match note or timeline item (confirming, correcting or removing it, or adding a note) is saved as a label: what the AI wrote, what the coach changed, the kind of mistake, any reason or advice the coach gave, and whether the athlete marked it "I disagree", with the version of the AI instructions that made the note. Coach marks on body tracking (7.5) are labels too. Labels and body-position summaries (7.4) may be put into a private training file for Luctaris's own experimental models only while everyone in the video, and the coach who made the label, have model training on, and while that coach is still connected to the athlete. The file contains no video, and the app leaves out the names and contact details it knows and any coach text that doesn't pass its checks, but it can miss a name. It is used only for this pilot and deleted by [FINAL DELETION DATE]. From the moment anyone turns model training off, their labels and summaries are left out of any new training file.

4.6 In the app, coaches and the Organizer see combined totals of how often coaches confirmed, corrected or removed the AI notes they checked ("coach agreement"). This is not a measure of accuracy. Totals are shown only when they include enough checked items, videos, athletes and coaches, with no one person making up most of them; they are rounded, updated once a day, and never shown per person or video. The Organizer also sees how many items, videos, athletes and coaches have been checked so far.

5. Google Cloud Gemini analysis

5.1 Joining includes Google Cloud Gemini analysis, through Google Cloud's Vertex AI service. It is used to write AI match notes on videos (section 6), to turn MatLog voice recaps into text, and to turn recap text into MatLog drafts.

5.2 For videos, the app sends Gemini a silent, low-resolution copy: no sound, a reduced picture, and phone details removed. The video you uploaded keeps its sound. With the copy, the app may send short text: coach corrections of earlier AI notes on your videos (6.9) and, when the feature in 7.4 is on, a summary of body positions from tracking (6.10). It leaves out the names it knows and coach text that looks like it contains a name, but it can miss one. For MatLog, your voice recaps and text are sent.

5.3 The app sends a video only when every person recorded for it has Gemini analysis on (for a training partner, see section 8). Daily limits apply.

5.4 Data may be stored in private [CLOUD STORAGE SERVICE AND REGION]. Processing may occur outside your country. Google receives no instruction to train on your data and may retain flagged submissions for up to 90 days, with staff access for abuse review, and may keep what it receives in short-term memory for up to 24 hours. No other outside AI service receives this data.

5.5 You can turn Gemini analysis off at any time (section 10).

6. AI match notes

6.1 After you upload a video of a round with a training partner, the app automatically asks Gemini to review it and write AI match notes: a short summary of the roll; a timeline of positions and moments that you can jump to in the video; what went well; things to work on, as technique suggestions; and, sometimes, questions to ask your coach. For a video of just you, you can ask for notes on the video's page.

6.2 You (the person who uploaded the video) and the coaches you are connected to in the app see the same notes as soon as they are ready, including every coach change (6.4).

6.3 The notes are automatic, and no person checks them before you and your coaches see them. They are labeled "AI notes", with the tag "Automatic, may be wrong". They can be wrong about what happened, when it happened or who did it. Treat them as a starting point to talk through with your coach, not as fact or as your coach's view. A note marked as confirmed or corrected by a coach shows that coach's view, and it can still be wrong.

6.4 A coach you are connected to can confirm, correct or remove any AI note or timeline item, or add their own note or advice, directly in the notes, without a review. A change shows at once to you and to your other connected coaches, marked with who made it, for example "Corrected by Coach" followed by the coach's name. The AI's original wording of a changed note stays one tap away, and a removed note stays visible, crossed out, with what the coach said was wrong and any reason they gave. You can't change a coach's correction, but you can mark it "I disagree", which your coaches see and which is saved with that change's label (4.5). The app keeps the AI's original wording with each change as a record until you turn Gemini analysis off or delete the video; if you leave, it is deleted with your other data within 14 days. If a coach's connection with you ends or they delete their account, their changes stay in your notes, shown as made by "a former coach" without their name, and are no longer used as guidance or in training files. You can't delete a coach's change yourself in the app. If an AI note is wrong, you can ask a connected coach to correct it (their correction then shows, and the earlier change stays listed with it). To have a coach's change or added note removed, tell the Organizer, who can delete a change by hand.

6.5 The AI is instructed to comment on technique only, and never to judge injury, pain, health, fitness or anyone's body, belt or rank, scores or winners, or who someone is, and never to name anyone. When it isn't sure, it is instructed to say so rather than guess. Some of its output is filtered. The instructions and filters can fail: ignore any note like that and tell us.

6.6 You decide whether and how to act on a note. AI match notes are not medical, injury, recovery, safety or fitness advice, and they are not a grading or promotion decision. Try any change in technique safely and within your own limits.

6.7 If notes can't be made for a video, the app says why in plain words.

6.8 These Terms also cover videos you uploaded before you accepted them. If you turned off coach review, body tracking or coach agreement counting (4.6) for one of those videos, it keeps that limit. The app doesn't make AI match notes for those videos automatically; you can ask for them on the video's page. The exception is a video whose training partner was confirmed under the earlier pilot consent: that confirmation doesn't cover AI match notes, so none are made for that video.

6.9 When AI match notes are made for one of your videos, Gemini may also receive, as text, up to 8 recent coach corrections of AI notes on your own videos, so that it can avoid the same mistakes. Only corrections from the last 120 days are used, and only from videos where everyone in the video has Gemini analysis and model training on, made by a coach who is still connected to you and has both on too. The app leaves out the names it knows and any coach text that looks like it contains a name or doesn't pass its checks, but it can miss a name; a coach's reason is never sent. The notes say when they were made with this guidance and which of the video's earlier corrections were used, and the app records every correction used. You can press "Re-run with coach feedback" on a video's page to make its notes again with that video's coach corrections; a connected coach can suggest it, but only you can start it. It uses the video's one re-run, and daily limits apply.

6.10 When a video has a saved body-position summary (7.4), Gemini may also receive a short text summary of it as hints, for example whether the two people are apart or touching, which figure is higher in the picture and how much they move. The hints are often wrong, and the AI is told to use them only to decide where to look and to write only what the video shows.

7. Body tracking on your device

7.1 When you watch a video in the app, you can turn on "Show body tracking (on this device)". The app then estimates approximate body points, including eyes, ears, nose, mouth corners and hand knuckles, for up to two people in the video and draws a stick figure over the video while it plays.

7.2 Tracking runs only in the browser of the person watching. The first time it is turned on, the browser downloads the tracking software and model (about 18 MB) from the Luctaris site. It does not recognize or identify anyone. Unless 7.4 applies, nothing it works out is uploaded, sent to Google or stored.

7.3 Tracking is often wrong in grappling, where bodies overlap and hide each other. It may not work on every device.

7.4 Body-position summaries. This feature is off until Luctaris turns it on; when it is on, the video page says so next to the tracking switch. Then, the first time the athlete whose video it is watches most of it with tracking on, the app in their browser sends Luctaris one summary for that video: about one reading per second of up to two people's shoulders, elbows, wrists, hips, knees, ankles and feet, as positions in the picture, with how sure the software is about each. It includes no face or hand points, no pictures and no sound. It is sent only for a video where everyone in it has Google Cloud Gemini analysis and model training on. It is kept privately with the video and used to help write AI match notes (sent to Gemini only as the short text in 6.10) and, under 4.5, to train Luctaris's own models. It is deleted with the video, when anyone in the video turns off Gemini analysis or model training or leaves the pilot, and by [FINAL DELETION DATE]. It is never used to recognize or identify anyone or to compare people across videos. If the athlete turns tracking off before the summary is sent, nothing is sent. A coach's viewing never sends one.

7.5 Coaches connected to the athlete can view a saved summary as moving figures over the video and mark where the tracking software mixed up the two people. These marks are labels (4.5).

8. Uploading videos and training partners

8.1 Upload only videos of yourself, alone or with one adult training partner, where no one else can be seen or heard. Every adult filmed must have agreed to these Terms before filming.

8.2 When you upload a video, you tick one box.

- If you're alone in the video: "I'm in this video, I'm an adult, and no one else is seen or heard."

- If you're with a training partner, you type your partner's full name and tick: "I'm in this video with my training partner, we're both adults, no one else is seen or heard, and my training partner read the Luctaris Terms and Conditions and agreed to them."

8.3 Tick only if every part is true. Before filming, show your partner these Terms, for example on your phone, and make sure they agree to all of them, including Google Cloud Gemini analysis, AI match notes that you and your connected coaches will see and your coaches may correct, body tracking and body-position summaries (7.4), and model training. If they don't agree to all of them, don't upload videos with them.

8.4 Your tick is your word that your partner agreed. It is not your partner's signature, and the app never presents it as one. The app keeps your partner's name as typed, the exact wording you ticked and its version, who ticked it and when, and which version of these Terms was in force. It keeps no email address or other contact details for your partner. These records are kept for [RECORD RETENTION PERIOD], even after the video is deleted.

8.5 For your partner, Gemini analysis and model training follow your confirmation, until they withdraw. A training partner withdraws, from the whole pilot or from Gemini analysis or model training only, by contacting the Organizer at [EMAIL], by phone or in person, not in the app. The Organizer records it for every video under their name, whoever uploaded it, and it applies at once. If they leave the pilot, the Organizer deletes the videos that show them within 14 days and confirms in writing. After a partner withdraws, even from Gemini analysis or model training only, the app refuses new videos under that name, or a close spelling of it, from every member. A withdrawal can't be undone in the app.

8.6 If you have your own account and someone else confirmed you as their training partner, your own choices in the app don't reach those videos; contact the Organizer about them.

8.7 Tell the Organizer promptly if someone in a video didn't agree or wants to withdraw.

9. Coaches in the pilot

9.1 [COACH FULL NAMES] may review your material in the private Coach Console. A coach sees your material only after you connect with them in the app. A connected coach can see your videos and their AI match notes, hear each video's sound, correct those notes and add their own (6.4), and, in a review you ask for, add review notes and feedback.

9.2 You can remove a coach's access at any time in Coach connections on your athlete home page. Their access to your material stops then.

9.3 Every coach has accepted these Terms, including the coach duties in section 12, before they can use Coach Console.

9.4 Coach feedback in the app is technique feedback. It is not medical or injury advice, or a grading or promotion decision.

10. Your choices, and leaving

10.1 Google Cloud Gemini analysis and model training are part of joining. You can turn either one off, or back on, at any time in [IN-APP WITHDRAWAL LOCATION]. A change takes effect at once.

10.2 If you turn Gemini analysis off, nothing more of your own goes to Gemini: not your videos, voice recaps or text. AI match notes are not made for your videos, MatLog voice recaps and AI drafts stop, and what Google analysis already made from your videos is deleted, including coach corrections and notes added to those AI notes, the labels made from them, and any saved body-position summaries (7.4). Your videos stay. Videos that someone else uploaded with you as their training partner follow 8.6 instead.

10.3 If you turn model training off, your material isn't used to train models from then on. Coach corrections on your videos are then left out of training files and are no longer sent to Gemini as guidance (6.9), and saved body-position summaries of your videos are deleted (7.4). If a model was trained with it, we stop using that model and delete or rebuild it within [MODEL RETIREMENT PERIOD] days.

10.4 Body tracking itself runs on the viewer's device, so these choices don't turn it off. If you turn off Gemini analysis or model training, no body-position summary is saved for your videos from then on, and any saved ones are deleted (7.4).

10.5 You can leave the pilot at any time in [IN-APP WITHDRAWAL LOCATION] or at [EMAIL]. We stop new use and coach access, delete active source data within 14 days, and stop using an affected model. The Organizer does this deletion by hand; the app does not delete files automatically on a schedule. Because model weights cannot be selectively untrained, we delete or rebuild that model within [MODEL RETIREMENT PERIOD] days. We confirm completion in writing.

10.6 You can also delete your account and data right away with Delete my account on the Privacy and data page.

11. End date and deletion limits

11.1 Source data, body-position summaries, individual labels, training files and experimental models are deleted by [FINAL DELETION DATE], within 12 months of collection. The Organizer does this by hand.

11.2 Inaccessible backups may last [VERIFIED BACKUP PERIOD] more days; Google's flagged submissions may last 90 days. Previously shared anonymous totals may remain. We keep a record of your acceptance, choices and withdrawal for [RECORD RETENTION PERIOD].

12. For coaches: your duties

12.1 This section applies to you if the Organizer approves you as a coach. You can't be approved as a coach until you have accepted the current version of these Terms. Your own material as an athlete is covered by the rest of these Terms.

12.2 You may review material that athletes share with you, only inside the app and only to give them coaching feedback. "Pilot Material" means anything you see or hear through the app, or learn from the Organizer, about the pilot or its participants (members and their training partners), such as videos and their sound, MatLog entries, AI match notes, coach notes, names and who takes part. It excludes what you learn outside the pilot, such as rounds you watch in person.

12.3 Give technique feedback only, not health or injury judgments. If you appear in a video you can review, or it seems to show someone under 18 or someone who did not agree to be filmed, don't review it; tell the Organizer.

12.4 Keep it private. Do not download, screenshot, screen-record, photograph, copy or share Pilot Material, or let others use your account. Do not put Pilot Material into any AI tool, chatbot, AI note-taker or transcriber outside the app. Do not identify any participant, or discuss their material, with anyone outside the pilot; you may discuss it with the Organizer and with the person who shared it or appears in it. Review in private, where no one else can see your screen or hear the sound.

12.5 Secure your account and device. Use Google sign-in with 2-Step Verification turned on, and a password used nowhere else. Use only your own devices, with a screen lock and current updates. Never use a public or shared computer.

12.6 Report problems within 24 hours. Email the Organizer at [EMAIL] within 24 hours of learning that Pilot Material may have been seen, kept or shared against this section, or that your device or account may be lost or misused. Follow the Organizer's instructions; only the Organizer notifies participants.

12.7 Your coach access ends when either of us says so, when you leave the pilot, or on [FINAL DELETION DATE] at the latest.

12.8 Keep your coaching notes in the app. When your access ends, when a participant withdraws (for their material), or when the Organizer asks, stop using Pilot Material, destroy any notes kept outside the app, and confirm in writing if asked.

12.9 Do not use Pilot Material for your own gym or business, social media, research, or any AI model or product outside the pilot. Pilot Material stays under the Organizer's control and each participant's choices. You get no rights to it or to the app.

12.10 You are not the Organizer's employee, partner or agent.

12.11 If the law requires you to disclose Pilot Material, tell the Organizer first where allowed, and disclose only what is required. The Organizer may seek a court order to stop a breach of this section. Clauses 12.4, 12.6, 12.8, 12.9 and 12.11 continue after your access ends and after the pilot ends, with no end date.

12.12 When you change AI match notes, your change, reason and advice are shown with your name to the athlete and to their other connected coaches at once. They are saved as labels (4.5). As your own Gemini analysis and model training settings allow, and while you are connected to the athlete, they may be put into training files, and your corrected text and advice (never your reason) may be sent to Gemini as guidance, without your name attached (6.9). If your connection with the athlete ends or you delete your account, your changes stay in the athlete's notes, shown as made by "a former coach" without your name. Don't put names, contact details, or health or injury remarks in them.

13. Rules for everyone

13.1 Don't:

- film or upload minors, bystanders, or anyone who hasn't agreed to these Terms;

- upload anything illegal, sexual, hateful or harassing, or anyone's private information;

- copy, screen-record or share other people's footage, notes or feedback that you see in the pilot;

- try to reach accounts or data that aren't yours, get around security or daily limits, or overload the app.

13.2 Tell the Organizer promptly if you think your account was misused.

14. A prototype, and not advice

14.1 MatLog, RollLens and Coach Console are early test versions. They may have errors, change or stop working, and they have no data export. Keep your own copy of anything you upload.

14.2 AI output in the pilot, including AI match notes, MatLog AI drafts and body tracking, can be wrong.

14.3 Nothing in the pilot is medical, injury, recovery or safety advice. If you are hurt or unwell, see a medical professional.

14.4 The pilot doesn't score matches, pick winners, rank people, or judge belt readiness or promotion. Coach feedback in the app is not a grading or promotion decision.

15. Your content and limits on our use

15.1 You keep whatever rights you have in what you upload or write. We use it only as these Terms allow.

15.2 Public or investor footage, marketing, selling or licensing identifiable material or experimental models, a permanent dataset, future sensors, identifying people or comparing them across videos from body data, and commercial use of models trained on pilot data need new permission. These Terms do not waive your legal rights or release anyone from training injury liability.

16. Pausing and ending the pilot

16.1 We may pause or switch off any feature (including AI match notes and body tracking), stop new sign-ups, suspend an account that breaks these Terms, or end the pilot early. The pilot is planned to end on [PILOT END DATE].

17. No warranty and limitation of liability

17.1 To the extent the law allows, the pilot is provided "as is" and "as available", without warranties of any kind, including about the accuracy of AI match notes or body tracking.

17.2 To the extent the law allows, the Organizer is not liable for indirect, incidental or consequential losses, or for lost data, arising from the app, and total liability for any claim about the app is limited to [LIABILITY CAP].

17.3 Nothing in these Terms limits liability that the law doesn't allow to be limited, waives your legal rights, or releases anyone from training injury liability.

18. Changes to these Terms

18.1 We may update these Terms. We will show you the new version in the app, and you will need to accept it before you continue using the pilot. If you don't agree, you can leave (section 10). Any new use of your data needs your new permission.

19. Law and contact

19.1 These Terms are governed by the laws of [STATE]. Questions, problems or withdrawal: [EMAIL], [ADDRESS].

19.2 These Terms are the whole agreement between you and the Organizer about the pilot.
